NO SLACK, INC (“NO SLACK”) warrants to the original purchaser (“Purchaser”) of the V-GYM™ that the
V-GYM™ is free from defects in material and workmanship under normal use and service for the period commencing upon the date of purchase as shown in the invoice and continuing for one year.

What is not covered?

This Limited Warranty is conditioned upon proper use of The V-GYM™ by Purchaser. This Limited Warranty does not cover: (a) defects or damage resulting from accident, misuse, abuse, neglect, unusual stress, or modification of any part of the V-GYM™ ; (b) any V-GYM™ that has the serial number removed or made illegible; (c) any plastic surfaces or other externally exposed parts that are scratched or damaged due to normal use; (d) defects or damage resulting from improper use; or (e) the batteries in the timer.

What will NO SLACK do?

When you contact us, we will issue a Return Material Authorization Number for you to include with your return. You must return the V-GYM™ to us in its original or equivalent packaging, prepay shipping charges, and insure the shipment or accept the risk if the product is lost or damaged while being shipped back to us. We will pay to ship the repaired or replaced V-GYM™ to you if you use an address in the United States (excluding Puerto Rico and U.S. possessions and territories). Otherwise, we will ship the V-GYM™ to you freight collect.

Upon receipt, we will promptly repair or replace any V-GYM™ that proves to be defective in materials or workmanship. We may, at our sole option, use rebuilt, reconditioned, or new parts or components when repairing any V-GYM™ or replace the V-GYM™ with a rebuilt, reconditioned or new V-GYM™ . All repaired/replaced V-Gyms™ will be warranted for a period equal to the remainder of the original Limited Warranty on the original V-GYM™ . All replaced parts, components and equipment shall become the property of NO SLACK.

If we determine that the problem is not covered under this warranty, we will notify you and inform you of service alternatives that are available to you on a fee basis.

What are the limits on NO SLACK'S liability?

NO SLACK SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. THIS LIMITED WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE . NOTHING CONTAINED IN THE VERTICAL GYM WEB SITE SHALL BE CONSTRUED TO CREATE AN EXPRESS OR IMPLIED WARRANTY OF ANY KIND.

Duration of implied warranties:

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE V-GYM™ IS LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. THIS LIMITED WARRANTY SHALL NOT EXTEND TO ANYONE OTHER THAN THE ORIGINAL PURCHASER OF THE V-GYM AND STATES PURCHASER'S EXCLUSIVE REMEDY.

The agents, employees, distributors, and dealers of NO SLACK are not authorized to make modifications to this Limited Warranty, or make additional warranties binding on NO SLACK. Was damaged in shipment,

SHIPMENT DAMAGES

If, upon receipt of the V-GYM™, you determine that the V-GYM™ was damaged in shipment, you must within one week after receipt, e-mail us at warranty@verticalgym.com .When you contact us, we will issue a Return Material Authorization Number.
